Since opening a private practice in Cheyenne Wyoming, attorney Karen Budd-Falen and others have been instrumental in providing a solid legal foundation for the process through court cases affirmed in the 9th and 10th federal court of appeals. When counties follow the correct legal procedure developed by Budd-Falen, they have never lost in court! During the last ten years, a dozen counties in Washington, Idaho, Oregon, California, Montana, Nevada and New Mexico have adopted this highly successful model. They have achieved joint standing with state and federal agencies in implementing environmental regulations locally. The success stories of four counties, Modoc County, California, Owyhee County, Idaho, Wallowa County, Oregon and Grays Harbor County, Washington are listed. They illustrate how the LEARN concept can help local government effectively deal with insensitive bureaucracies by utilizing the local planning process to develop working relationships with federal agenciesand to engage local county residents in the work of protecting the stability of their community.
